This Act implemented the relevant provisions from the Council of Europe Convention in the Aliens Act. Among other matters, this deals with Article 13, subsection 1 of the Council of Europe Convention, in accordance with which Member States must establish a period for restoration and reflection of at least 30 days when there are reasonable grounds to assume that a citizen of a foreign country has been a victim of human trafficking. The period must be sufficient to allow the person in question to regain his/her health, to evade the influence of human traffickers and/or to make an informed decision to cooperate with the competent authorities.\par\par The Danish Immigration Service evaluates the issue of human trafficking as far as it concerns foreign citizenswho receive support from the Danish Immigration Service, i.e. asylum seekers and foreign citizens who are not legal residents in Denmark. This is due to the fact that the Aliens Act contains specific rules and provisions regarding human trafficking. In addition to extended provisions regarding financial support and assistance, foreign citizens who have been the victims of trafficking who must leave Denmark are entitled to an extended exit deadline \endasha 30-day period for reflection with the option of an extension of up to 100 days (Section 33, subsection 13 of the Aliens Act) \endash and an offer of prepared repatriation. Furthermore, there is a particularly lenient rule on deportation (Section{\*\xmlopen\xmlns2{\factoidname metricconverter}{\xmlattr\xmlattrns0{\xmlattrname ProductID}{\xmlattrvalue 26 a}}}26 a{\*\xmlclose} of the Aliens Act) for victims of trafficking.\par \page Foreign citizens who are victims of trafficking and receive support from the Danish Immigration Service are normally identified in connection with 1) processing asylum applications when information that indicates trafficking emerges during an interview, or 2) because the police have arrested a foreign citizen who is not a legal resident in Denmark, after which information on trafficking emerges during police questioning or during an interview at the Danish Centre against Human Trafficking (CMM) with the person in question.\par\par If the foreign citizen is identified in connection with processing an asylum application, a period for reflection will only come into effect if the application for asylum is rejected and the person in question must leave Denmark. If the foreign citizen is identified on the basis of a submission on the part of the police and CMM and does not seek asylum, the issue of a period for reflection comes into effect immediately because the person in question cannot be permitted to stay in Denmark.\par\par When the police arrest a foreign citizen who is not a legal resident, the matter is referred to the Danish Immigration Service where a decision is made regarding deportation or a refusal. If there is a suspicion of trafficking in connection with a police raid at a known haunt of prostitutes, for instance, the police will contact CMM and the foreign citizen in question can obtain an interview with a CMM employee. During such an interview, the CMMemployee fills in an identification form, drawn up in collaboration with the Danish Immigration Service and, together with the information from the police, this constitutes the basis for an evaluation of the trafficking issue on the part of the Danish Immigration Service. The form contains 26 items, including an item stating whether the foreign citizen has been a victim of trafficking. The CMM employee can cross off the following options: 'Trafficked', 'Suspicion of trafficking, but cannot be evaluated', 'Noimmediate suspicion, but cannot be evaluated', or 'Not trafficked'. In addition, a further 25 items are filled in and the CMM employee can describe certain circumstances in greater detail. Where there is a 'Suspicion of trafficking, but cannot be evaluated', this should be supplemented by any indications of human trafficking if, for instance, the foreign citizen has given information on the presence of a principal who has exploited the person in question, on elements of coercion in connection with travelling to or staying in Denmark, or on the confiscation of personal documents, etc., if the Danish Immigration Service is to evaluate whether this is a case of trafficking. The foreign citizen will always be given the benefit of the doubt.\par\par This is how the Danish Immigration Service decides whether a foreign citizen has been the victim of human trafficking when \endash on the basis of information supplied by the police and CMM \endashthere are reasonable grounds to assume the case in question involves such trafficking. The foreign citizen is also offered prepared repatriation which he or she must cooperate on the organisation of, if he or she accepts it.\par\par In March 2008, the Danish Immigration Service entered into a contract with the International Organisation for Migration (IOM), which remains in effect until 31 December 2010, with respect to that part of prepared repatriation that concerns the preparation of reintegration plans, including reception and activities in the native country.\par\par In concrete cases, the foreign citizen's contact from the Danish Centre against Human Trafficking (assigned to all foreign victims of trafficking) will, in collaboration with the foreign citizen and the IOM, draw up an individually adapted reintegration plan. The plan is prepared on the basis of the individual's wishes and background. The IOM handles contacts with the relevant local authorities or organisations in connection with repatriation and the foreign citizen's stay in his or her native country.\par\par The reintegration plan is in effect for three months after the person in question arrives in his or her native country. Examples of elements in the reintegration plan that can be mentioned are reception in the native country by a person from the local IOM office, accommodation at a crisis centre, and the opportunity to attend language courses, hairdressing school, manicure courses, or a course on starting up a company, and medical help.\par \page The IOM provides documenta\ltrpar tion for the reintegration process in a report after the expiry of the three months and evaluates the experience gained from the concrete case.
